Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you" or "your") and LumeVista Marketing LLC, a Washington State limited liability company doing business as DryLine ("DryLine," "we," "us," or "our"). They govern your access to and use of the DryLine website at drylineapp.com and the DryLine web application (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms, and "you" includes that business.

2. Your account

You are responsible for the information you provide and for all activity under your account. Keep your login credentials secure and notify us promptly at hello@drylineapp.com if you suspect unauthorized use. You may create accounts for members of your crew; you are responsible for their use of the Service.

3. The Service

DryLine provides weather-intelligence and job-management tools for painting contractors, including comparing live and forecasted weather conditions against your scheduled jobs, paint-risk scoring, a multi-day forecast, job management, and time tracking. Features vary by subscription plan and may change over time as we improve the Service.

4. Subscriptions, trials, and billing

Free trial. We may offer a free trial (currently 14 days, no credit card required). At the end of the trial, you must select a paid plan to continue using paid features.

Plans and pricing. Paid plans and their current prices are shown on our pricing page. As of the effective date these are: Solo ($29/month), Pro ($79/month), and Team ($79/month base plus $19/month per additional seat). Annual billing, where offered, provides a discount (currently two months free versus monthly). We may change prices; we will give you reasonable advance notice, and changes take effect on your next billing cycle. Certain users may receive promotional or grandfathered pricing as separately agreed.

Billing and renewal. Paid subscriptions are billed in advance through our payment processor, Stripe, and renew automatically each billing period until canceled. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis. You are responsible for any applicable taxes.

Cancellation and refunds. You may cancel at any time, and your subscription will remain active through the end of the current paid period. Cancellation stops future renewals. Except where required by law, payments are non-refundable, and we do not provide refunds or credits for partial periods, unused time, or features not used.

5. Your content and data

You retain all rights to the data you submit to the Service, including information about your jobs, customers, and crew ("Your Content"). You grant DryLine a limited license to host, store, process, and display Your Content solely to provide and improve the Service.

You are responsible for Your Content and for having the rights and permissions needed to submit it — including any personal information about your own customers. You agree not to submit content that you do not have the right to use or that violates the rights of others. Our handling of personal information is described in our Privacy Policy.

7. Third-party services

The Service relies on third-party providers, including Stripe (payments) and OpenWeatherMap (weather data), and may rely on others. Your use of those features may be subject to the third party's own terms. We are not responsible for third-party services, and their availability or accuracy is outside our control.

8. Weather data — important disclaimer

The weather information, forecasts, paint-risk scores, and related guidance provided by the Service are informational and advisory only. They are derived in part from third-party data sources (such as OpenWeatherMap) and from models and thresholds that are not guaranteed to be accurate, complete, or suited to your specific job, materials, or conditions.

DryLine does not guarantee weather conditions or outcomes, and is not a substitute for your own professional judgment. You are solely responsible for decisions about whether, when, and how to paint, including reliance on manufacturer specifications and on-site assessment. DryLine is not liable for any paint failure, project delay, material loss, callback, warranty claim, or other loss arising from weather conditions or from your reliance on the Service.

9. Intellectual property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by LumeVista Marketing LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. You may not use the DryLine name or logo without our permission.

10. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data or output will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, DryLine and LumeVista Marketing LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless DryLine and LumeVista Marketing LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any law or the rights of a third party.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.

14. Changes to the Service and to these Terms

We may modify or discontinue features of the Service at any time. We may also update these Terms; when we make material changes, we will update the "Effective date" and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Washington State will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction there.

16. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
